These Terms and Conditions (“Terms”) constitute a binding agreement between You and A&B and govern Your use of this Website and any purchases made through the A&B Website. 

If You do not agree to these Terms, you are not permitted to use Our Website.

Definitions

Eligibility to Use the Website 

By using this Website, You confirm that: 

• You are legally capable of entering into binding agreements; 

• The information you provide is accurate and complete; and 

• You will not use the website for unlawful or fraudulent purposes 

• Not to violate the provisions of these Terms and/or and policies published by A&B on the Website.

You acknowledges that failure by You to fulfill any of the obligations referred to above may result in suspension of Your account on the Website without the need for any prior notice from A&B. Accordingly, the You undertakes not to resume using the Website unless You obtain A&B’s written approval to do so.

Service Terms

Products & Availability 

We strive to ensure that all Items, descriptions, images, pricing, and availability information are accurate. 

However: 

• Item colors may appear differently depending on device screens.

• Availability may change without notice.

• Certain Item s may be discontinued at any time.

We reserve the right to: 

• Modify products 

• Limit quantities 

• Refuse or cancel orders 

• Update product information without prior notice 

Orders

Order Confirmation 

An order is considered confirmed only when payment has been successfully completed and You receive an order confirmation via email, SMS, or WhatsApp 

Orders will not be processed without successful payment authorization. 

Order Acceptance or Cancellation 

Users may request order cancellation only before the order has been shipped. 

Once an order has been shipped, cancellation is no longer possible, and the order will be subject to the applicable Return, Exchange & Refund Policy below. 

We reserve the right to not to accept or cancel any orders at our discretion in cases including but not limited to: 

• Payment authorization failure

• Fraud prevention review

• Inventory issues

• Operational limitations

• Pricing or system errors

• Violation of these Terms

If payment has already been processed for a canceled order, the amount will be refunded to the original payment method. 

Pricing 

All prices displayed on the Website are: 

• Listed in the applicable currency 

• Inclusive of VAT where required by law 

Item prices do not include shipping fees, customs duties, or other additional charges.

We reserve the right to update prices at any time without prior notice. 

Payment

We accept secure payments through approved third-party payment providers, which will be available at the checkout when making an order. 

We do not store payment card details, and all payment transactions are encrypted and processed securely through third-party payment providers. 

Shipping

Delivery Regions 

We currently offer shipping: 

• Within the Kingdom of Saudi Arabia (KSA) 

• Internationally to selected countries available at checkout 

Shipping availability may change at any time without prior notice. 

We reserve the right to refuse or cancel orders to locations where shipping is unavailable, restricted, or considered high-risk. 

Order Processing Time 

Orders are typically processed by A&B within 1–2 business days after successful payment confirmation. 

Orders are not processed, shipped, or delivered on official holidays in Saudi Arabia.

During periods of high demand, promotions, holidays, or special launches, processing times may be extended. 

Once an order has been shipped, customers will receive a tracking number via email, SMS and/or WhatsApp (where applicable).

Tracking information may take time to update depending on the shipping carrier.

Estimated delivery time: 2-7 business days 

International Orders 

Estimated delivery time: 5–10 business days 

International shipping times may vary depending on, destination country customs clearance, shipping carrier operations, local delivery conditions. You acknowledge that delivery times are estimates only and are not guaranteed. 

While we aim to deliver orders within the estimated timeframe, we are not liable for delays caused by third-party shipping carriers or customs authorities delays that may occur.

Shipping Fees 

Shipping fees are calculated at checkout based on: 

• Delivery location 

• Shipping method 

• Package size or weight 

• Applicable courier rates 

Promotional free shipping offers may be available from time to time and will be displayed on the website where applicable. 

Incorrect Shipping Information 

Customers are responsible for providing complete and accurate shipping information. 

If incorrect or incomplete shipping details are provided: 

• Delivery may be delayed 

• Additional shipping charges may apply 

• Orders may be returned to us 

• Re-delivery fees may be charged 

We are not responsible for failed deliveries caused by incorrect Customer information. 

Refused or Unclaimed Shipments 

If a shipment is refused, abandoned, or remains unclaimed by the Customer, fees such as return shipping fees, customs charges or handling fees may be deducted from any eligible refund. 

In some cases, international shipments may not be returned to us by the courier or customs authority. 

Shipping Carriers 

We work with trusted shipping providers. The Carrier availability which may vary depending on destination and operational conditions and might be available at the checkout when completing a purchase.

Customs Duties & Import Taxes (International Orders) 

For international orders: 

• Customers are responsible for any customs duties, import taxes, VAT, handling fees, or other charges imposed by the destination country 

• These charges are determined by local customs authorities and are outside our control 

Failure to pay customs or import charges may result in: 

• Delivery delays 

• Return of shipment 

• Shipment destruction by customs authorities 

We are not responsible for additional charges imposed by customs or government authorities outside Saudi Arabia.

Damaged Packages 

If your package arrives visibly damaged: 

• Please document the condition immediately 

• Contact us as soon as possible 

• Provide photos or videos of: Packaging, Shipping label and Product condition.

Claims related to damaged shipments may be rejected if reported excessively late or without sufficient proof. 

Returns, Exchanges and Refunds Policy

Returns and Exchanges Period 

Customers may request a return within 7 calendar days from the date of delivery.

To be eligible, the return request must be submitted within this 7-day period. Requests submitted after 7 days from delivery may not be accepted.

Eligibility for Return and Exchange

To be eligible for a return, the Products must be: 

• Unused, unaltered and unworn with original tags attached and in their original condition

• In its original packaging 

Returns or Exchanges will not be accepted if: 

• The item has been worn or used 

• Tags have been removed 

• The original packaging is missing 

• The item shows signs of damage caused after delivery 

• The item is not in a resell able condition 

Non-Returnable Items 

The following items are not eligible for return or exchange: 

• Swimwear, Underwear or intimate wear 

• Sports bras 

• Customized or personalized products 

For hygiene reasons, underwear, intimate wear, and sports bras cannot be returned or exchanged unless the item is defective or the wrong item was delivered and in all cases such items must include the original hygiene liner.

Return and Exchange Shipping Costs 

Customers are responsible for return or exchange shipping costs in the following cases: 

• The Customer Changes their mind and no longer wants the item.

• Size or fit issues

We will cover return or exchange shipping costs if: 

• The item is defective 

• The item is damaged upon delivery 

• The wrong item was delivered 

Photo or video proof may be required to process a return request, especially for damaged, defective, or incorrect items.

Refunds

Once we receive the returned item, it will be inspected. After inspection, we will notify the Customer whether the refund has been approved or rejected.

Approved refunds will be issued to the original payment method unless A&B is not able to refund to the original payment method for any reason.

Refunds are usually processed by us within 3–14 days after approval. However, the time it takes for the amount to appear in the Customer’s account may vary depending on the bank, card issuer, or payment provider. 

Requesting a Return or Exchange

Please include order number, full name, reason for return and photos or videos, if applicable. Items sent back without prior return approval may not be accepted. 

Our team will review the request and provide return instructions if the return is approved. 

Promotional Codes and Discounts

A&B from time to time, may offer promotional codes, discounts, or special offers to Users subject to specific terms and conditions determined by A&B. Promotions are non-transferable, may not be exchanged for cash, and may only be used within the validity period specified by A&B. 

A&B reserves the right to amend, suspend, or cancel any promotion at any time without prior notice in the event of misuse, fraud, technical issues, or violation of these Terms.

A&B reserves the right to discontinue any promotions.

Errors & Inaccuracies 

We make reasonable efforts to ensure website accuracy. However, errors may occasionally occur, including: 

• Pricing errors 

• Product description inaccuracies 

• Availability issues 

• Technical or typographical errors 

In such cases, we reserve the right to, correct the error, cancel affected orders, refuse transactions and/ or contact customers for clarification or updated instructions 

Third-Party Content

The Website may contain information, data, software, photographs, charts, videos, graphics, audio, and other materials owned by a third party, such comments by Customers (collectively referred to as “Third-Party Content”). Third-Party Content reflects only the views of its owners and represents them alone. Third-Party Content shall not in any way be deemed to represent A&B, and the display of Third-Party Content on the Website shall not be deemed approval by A&B of its content or endorsement by A&B thereof.

Linking with Third-Party Websites

The Website contains features designed to connect to websites that may belong to third parties as an essential part of A&B. The User agrees that such essential integrations shall form part of the Services and be included in their fees unless otherwise stated in writing in the payment invoice. Although A&B will use its reasonable best efforts to maintain the continuous availability of these features, A&B cannot guarantee their continued availability.

Temporary Suspension of Accounts

A&B has the right, without prejudice to any other right it has under this Agreement, including the right of termination, to temporarily suspend the User’s account, while reserving the right not to refund paid Service fees, in the event of:

• Use of the Website in a manner that violates the local laws and regulations of the Kingdom; or

• Use of the Website in a manner that adversely affects A&B, causes damage or an issue on the Website and/or to A&B and/or to any third party.

If the User’s account is suspended by A&B for any of the reasons above, and a period of no less than fifteen (15) calendar days has passed, A&B shall send a notice to the User explaining that if the User does not take the necessary actions to fully remedy the cause of suspension, A&B shall have the right to permanently delete the User’s account after the lapse of an additional ten (10) calendar days, without any liability arising on A&B.

Intellectual Property

The User acknowledges and agrees that all Intellectual Property rights in the Website are exclusively owned by A&B or are owned by a third party and displayed by A&B with authorization from such party. The User also acknowledges and agrees that A&B grants the User the right to access and/or use the Website, and that the User has no rights of any kind relating to and/or arising from the Website other than as expressly set out in this Agreement.

The User is not permitted to use, copy, modify, alter, reproduce, publish, display, distribute, store, transfer, or commercially exploit any property related to A&B, including, without limitation, Intellectual Property rights, without obtaining A&B’s prior written consent. The User further acknowledges that nothing in this Agreement is intended, or may be understood, to grant the User any right or license in and/or to any A&B content unless expressly stated in this Agreement.

Force Majeure

Neither A&B nor the User shall be deemed to have defaulted in performing its obligations under this Agreement or to have breached any provision of this Agreement if the cause preventing performance of such obligations is the occurrence of a force majeure event arising after the commencement date of this Agreement. If either party considers that a force majeure event has occurred and that such event may affect the performance of its obligations under this Agreement, it must notify the other party in writing as soon as possible, and in any event no later than fourteen (14) business days from the start of such event.

Limitation of Liability

Although A&B seeks to take precautions relating to Website security by using a server with high-security technology to store User account data and content, and although A&B seeks to take precautions that promote integrity in buying and selling and limit fraud, deception, and misrepresentation by establishing and publishing the provisions of this Agreement and the Privacy Policy, it is not possible to exclude the possibility that some users or third parties may commit violations of these provisions and also violate the laws and regulations of Saudi Arabia. Accordingly, the following should be noted:

A&B and any of its affiliates shall not be liable to the User for any indirect, incidental, special, consequential, or punitive damages, even if A&B has been informed of the possibility of such damages.

A&B and any of its affiliates shall not be liable for any compensation or refund of fees for any damages arising from the User’s inability to use the Services, including any damages resulting from any termination or suspension of part or all of this Agreement and/or the User account and/or use of and/or access to the Website and/or the Services, or any unexpected or unplanned interruption of all or part of the Services for any reason, including, without limitation: (a) the cost of purchasing alternative services; (b) any investments, expenses, or obligations by the User in connection with this Agreement or the User’s use of or access to the Services; and/or (c) any unauthorized access to, alteration, deletion, destruction, damage, loss, or failure to store any User content or other related data. In all cases, A&B’s liability under this Agreement shall not exceed the amount of fees actually paid by the User to A&B under this Agreement for the Website and/or Services during the three (3) months preceding the establishment of liability.

Comments, Feedback, and Suggestions

A&B appreciates all comments, feedback, and suggestions from users regarding the Website. By submitting comments, feedback, and/or suggestions to A&B through the Website, the User grants A&B and its affiliates permission to use, modify, copy, publish, and distribute all of the User’s comments, feedback, and suggestions on a permanent basis, without any restrictions and/or conditions, throughout the world, without any consideration or compensation of any kind.

If the User does not wish to grant A&B the rights relating to such comments, feedback, and suggestions, the User shall refrain from submitting, sending, and/or publishing comments, feedback, and suggestions on the Website.

Suspension of Use

If the User does not comply with the terms and provisions of this Agreement, or for any other reason, the User agrees that A&B has the right to suspend the User’s use of the Website at A&B’s sole discretion. A&B also has the right to terminate the User’s access to the Website without prior notice.

Confidentiality

The User must keep A&B’s Confidential Information strictly confidential and may not, without A&B’s prior written consent, use or disclose any of A&B’s Confidential Information, directly or indirectly, to any third party, except for the following, with prior notice to A&B within a reasonable period so that A&B can take appropriate measures: (a) Confidential Information that becomes generally known to the public without any improper act and/or omission by the User; and/or (b) disclosure of portions of A&B’s Confidential Information that are required to be disclosed by law and/or pursuant to a final court judgment and/or pursuant to an order issued by the relevant competent authorities.

Governing Law and Dispute Resolution

This Agreement shall be governed by the laws and regulations of the Kingdom. If a dispute arises between the User and A&B, it must be resolved amicably within fifteen (15) days from the date of written notice given by one party to the other notifying it of the existence of such dispute. If an amicable resolution cannot be reached within the fifteen-day period specified above, the dispute shall be referred to the competent court in the city of Jeddah.

Correspondence

All communications and notices required under this Agreement must be in writing and shall be deemed duly given when sent by email. All emails and notices sent to A&B must be sent to the following email address: (legal@aandblabel.com)     

The User acknowledges that A&B will send communications necessary to provide the Services to the User, such as responses to password reset requests and/or customer support requests and the like, and the User cannot unsubscribe from such communications.

The User acknowledges that the User is solely responsible for notifying A&B of any change to the User’s address and contact information as soon as possible.

Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to its subject matter. This Agreement supersedes and replaces any prior agreements, representations, understandings, or correspondence, whether oral or written, relating to the subject matter of this Agreement.

No Waiver of Rights

If either A&B or the User does not insist, at any time, on the other party’s performance of its obligations or representations set out in this Agreement, or if either A&B or the User fails to exercise any of the rights or remedies granted to it under this Agreement, this shall not constitute a waiver of such rights or remedies and shall not relieve the other party from compliance with such obligations. No waiver by A&B or the User of any default shall constitute a waiver of any subsequent default.

Nature of the Relationship

The User acknowledges that the relationship between A&B and the User is solely a service-provision relationship consisting of displaying Seller product data and facilitating access to it, and nothing in this Agreement shall be deemed to create a partnership, agency, employment, or representation relationship between A&B and the User.

Prevailing Language

In the event of any conflict or difference in meaning between the Arabic and English texts of this Agreement, the Arabic text shall prevail over the English text.

Severability

If any term or provision of this Agreement becomes illegal, invalid, or unenforceable under any laws applicable to this Agreement, such term or provision shall be deleted, and this shall not affect the validity and enforceability of the remaining terms and provisions of the Agreement.

Assignment

The User may not transfer any right granted to the User under the terms of this Agreement and/or license or permit any person or third party to access the Website, in whole or in part, without A&B’s prior written consent. Any attempt to do so shall be null and void.

Amendment to the Agreement

Without directly conflicting with any other provisions set out in other agreements or policies to which the User is subject, A&B reserves the right to amend this Agreement at any time by publishing an amended version on the Website or by notifying the User in accordance with the other communication provisions under this Agreement.
